Information we collect

Information you provide. We collect information you give us when you browse, create an account, place or redeem a gift order, request a quote, or contact us. Depending on the service, this includes names, email addresses, phone numbers, billing and delivery addresses, company details, account information, order history, gift selections, gift messages, personalization materials, and support correspondence.

Information from gift senders. A person or organization sending you a gift may provide your name, contact details, delivery information, and a gift message. You may also provide information directly when accepting or redeeming a gift. Senders should provide only information they are authorized to share for the gifting service.

Payment information. Payment providers process payments for purchases. We receive information needed to manage the transaction, such as payment status and transaction references. Payment providers also process personal information under their own privacy notices.

Information collected automatically. Our website and technology providers collect information such as IP addresses, browser and device information, cookie identifiers, pages viewed, interactions, and information about how you reached our website. We use cookies, pixels, and similar technologies as described below.

How we use information

We use personal information to process payments and orders; prepare and personalize gifts; contact recipients; support gift selection, redemption, shipping, and delivery; provide order updates; manage accounts and corporate gifting programs; and respond to questions or requests.

We also use information to operate and improve our website, understand use of our services, measure advertising, market Fountain to customers and prospective customers, prevent fraud and misuse, keep business records, and meet legal obligations.

Our team and fulfillment providers use gift messages and personalization materials as needed to prepare and support your gift.

Gift recipients and corporate gifting

We use recipient information to provide the gifting service, including gift notifications, redemption, delivery, and related assistance. We do not send promotional emails or promotional text messages to people simply because they received a gift.

When a recipient submits a delivery address directly through GiftDrop or Fountain Pro, we do not disclose that address to the gift sender or corporate customer. We use it to fulfill the gift, including sharing it with providers involved in delivery.

When a business arranges gifts for employees, clients, or other recipients, it may also process personal information under its own privacy policy.

How we disclose information

Service providers. We disclose information to providers that help operate our services, including payment processing, hosting, technical support, order fulfillment, shipping, customer communications, analytics, and security.

Advertising partners. We disclose certain customer and website-use information to advertising platforms, including Meta/Facebook and Google, for Fountain’s advertising as described below.

Other disclosures. We may disclose information as necessary to comply with legal obligations, respond to lawful requests, protect people and our services, prevent fraud, establish or defend legal claims, or carry out a business transaction such as a merger or sale, subject to applicable law. We may also disclose information at your direction.

Cookies, advertising, and your choices

We do not sell customer or recipient lists for money, and we do not provide those lists to other companies to market their own unrelated products or services. We do use advertising platforms to promote Fountain.

We use Meta/Facebook and Google advertising and upload customer lists to advertising platforms to help reach customers and relevant audiences. Our website also uses Google Analytics and Google Ads. These services can involve disclosure of contact identifiers, device or cookie identifiers, and information about website interactions.

Under some privacy laws, these advertising activities may be considered “sale,” “sharing,” or “targeted advertising.” You may request to opt out as described below.

You can contact [email protected] or text (908) 540-6919 to request that we stop using your information for targeted advertising or advertising-audience uploads. Please identify the email address associated with your request; do not send passwords or payment details.

Your browser may let you restrict cookies, and advertising platforms provide their own advertising settings. Restricting cookies may affect website functionality. Browser settings alone may not stop customer-list uploads.

Email and text communications

We use email and text messages for order and gift-related communications and customer support. Gift recipients are not added to promotional email or text campaigns merely because they receive a gift.

You can unsubscribe from promotional emails using the link in the message or by contacting us. If you have subscribed to promotional text messages, follow the opt-out instructions in those messages or contact us. Opting out of promotions does not by itself stop necessary order, delivery, or account communications.

How long we keep information

We retain personal information for as long as reasonably necessary for the purposes described in this policy, including maintaining accounts and order history, providing services and support, accounting and tax records, fraud prevention, resolving disputes, and meeting legal obligations.

How long we keep information depends on its purpose, our relationship with you, and applicable legal requirements. We review deletion requests under applicable law and may retain records where permitted or required, such as for tax, order, or legal obligations.

Privacy requests

Depending on where you live and which laws apply, you may have rights to access or obtain a copy of personal information, correct inaccuracies, request deletion, and opt out of certain uses or disclosures, including sale, sharing, or targeted advertising. These rights are subject to applicable conditions and exceptions.

We will not require identity verification for opt-out requests where the law prohibits it. We respond within the time required by applicable law and explain any permitted refusal or extension.

Where you have a right to appeal a decision, reply to our response or email [email protected] with “Privacy Appeal.” We will review the appeal and provide the response and further complaint information required by applicable law. We do not unlawfully discriminate against you for exercising privacy rights.

Security and other websites

We use reasonable administrative, technical, and organizational safeguards to protect personal information. No method of transmission or storage is completely secure. Please keep your account credentials private and contact us if you suspect unauthorized access.

Our website may link to other websites or services. Their handling of information is governed by their own privacy notices.

Children’s privacy

Our website and purchasing services are not directed to children under 13. If you believe a child has provided personal information directly to us without appropriate authorization, please contact us so we can review and address the situation under applicable law.
